З урахуванням пунктів 3.6., 10.3, 15.7, Договору №09/137-06/2022 від 24.06.2022 р., на підставі листа ПОСТАЧАЛЬНИКА про проведення попередньої оплати № 701 від 24.10.2022 р. та банківської гарантії № APGRLO918410 ei,n l 8.10.2022p.., ЗАМОВНИКОМ проводиться попередня оплата в розмірі 100 (ста) відсотків від ціни продукції, вказаної у Специфікації (Додаток №1 до Договору), на підставі оригіналу рахунку-фактури. Примітка: закупівля здійснювалась відповідно до постанови Кабінету Міністрів України від 28 лютого 2022 р. № 169 у редакції, чинній на 28.06.2022 р. Відповідно до абзацу першого підпункту 1 пункту 1 Постанови в умовах воєнного стану оборонні та публічні закупівлі товарів, робіт і послуг здійснюються без застосування процедур закупівель та спрощених закупівель, визначених Законами України “Про публічні закупівлі” та “Про оборонні закупівлі”. Підстава "покращення якості предмета закупівлі, за умови що таке покращення не призведе до збільшення суми, визначеної в договорі про закупівлю" обрана у зв'язку із відсутністю в електронній системі підстави, яка відповідала б предмету додаткової угоди.
