Збільшення ціни за одиницю товару з урахуванням установлення нового офіційного курсу гривні до далару США на підставі Постанови Правління Національного банку України від 21.07.2022 №154 “Про внесення змін до Постанови Правління Національного банку України від 24.02.2022 №18”, з одночасним пропорційним зменшенням обсягу закупівлі та ціни договору.

У зв’язку з коливанням вартості товару на ринку Сторони зменшили вартість одиниці товару із пропорційним збільшенням його кількості та зменшенням загальної суми договору. Також до договору внесені інші зміни (передбачена поставка товару не за графіком, а відповідно до заявок Замовника). Сторони встановили, що передбачені цією додатковою угодою зміни згідно ст.631 ЦК України починають діяти з 22.05.2023р.

Приймаючи до уваги зміну обставин, за яких укладався Договір (надзвичайна ситуація, пов’язана з підривом Каховської ГЕС, через що Замовник вимушений був змінити джерело отримання води для забезпечення централізованого водопостачання міста Покров), для належного очищення води з іншого джерела (р.Базавлук) Замовник має потребу в отриманні Товару (коагулянта) з іншими технічними характеристиками порівняно з Товаром, який застосовувався для очищення води з Каховського водосховища. Сторонами враховано, що Товар з іншими технічними характеристиками (хлорид поліалюмінію MO-PAC 24 UHB-M) є подібним Товару, який передбачений Договором, і має той самий код згідно ДК 021:2015: 24310000-0 «Основні неорганічні хімічні речовини». З урахуванням наведеного Сторони уточнили фактичний обсяг і ціну вже отриманого товару (коагулянта гідроксихлорида алюмінію), доповнили перелік Товарів, які закуповуються згідно Договору (додано коагулянт хлорид поліалюмінію MO-PAC 24 UHB-M в кількості 8,94 тони), уточнено (зменшено) обсяг товару по Договору (всього 42,06 тони) та відповідно до фактичних потреб Замовника уточнили (зменшили) загальну ціну Договору.
