Постановою КМУ України №211 від 11 березня 2020 року (зі змінами) «Про запобігання поширенню на території України гострої респіраторної хвороби COVID-19, спричиненої коронавірусом SARS-CoV-2», статтями 651,653-654 Цивільного кодексу України, відповідно до п. 4.1.,11.1.,11.2.,11.6, розділом 8 Договору, у зв’язку з тим, що коронавірусна інфекція (COVID-19, SARS-CoV-2) є надзвичайною обставиною, оскільки носить винятковий загальнонаціональний характер і знаходиться поза межами впливу сторін договору. В той же час, ця пандемія та обмеження, запроваджені у зв’язку із нею органами державної влади та місцевого самоврядування, є і невідворотною (непереборною) обставиною, оскільки мають неминучий характер, зумовлений зовнішніми факторами, що об’єктивно унеможливлюють виконання зобов’язань, передбачених умовами договору (контракту, угоди тощо), обов’язків згідно із законодавчими та іншими нормативними актами.
