Відповідно до пункту 2 частини 4 статті 36 Закону про публічні закупівлі, істотні умови договору про закупівлю не можуть змінюватися після його підписання до виконання зобов’язань сторонами в повному обсязі, крім випадків: зміни ціни за одиницю товару не більше ніж на 10 відсотків у разі коливання ціни такого товару на ринку, за умови, що зазначена зміна не призведе до збільшення суми, визначеної в договорі.
Користуючись даним нормативно встановленим правом, замовник уклав додаткову угоду та оприлюднює повідомлення про внесення змін до договору в електронну систему закупівель.
