У зв’язку з виникненням об’єктивних обставин, що підтверджуються листом Підрядника від 14.01.2021 №41 відповідно до вимог п. 3 ч. 4 ст. 36 ЗУ «Про публічні закупівлі» Сторони дійшли згоди викласти п.3.1. Договору у наступній редакції: «Ціна Договору є твердою, становить 19 212 321 грн. 09 коп. (дев’ятнадцять мільйонів двісті дванадцять тисяч триста двадцять одна грн. 09 коп.), окрім цього 20% ПДВ у сумі 3 805 339 грн. 22 коп. (три мільйони вісімсот п’ять тисяч триста тридцять дев’ять грн. 22 коп.), а всього 23 017 660,31 грн. (двадцять три мільйони сімнадцять тисяч шістсот шістдесят грн. 31 коп.) з ПДВ, визначається кошторисом (Додаток №1), який складається за допомогою програмного забезпечення АВК-5 та є невід’ємною частиною Договору. У ціну Договору включено вартість програмного забезпечення «Ліцензія ОІК АВВ «MicroScada Pro» 900 точок, 1xMonitorPro+, 1xIEC 60870-5-104 Master» вартістю 185 625,00 (сто вісімдесят п’ять тисяч шістсот двадцять п’ять грн), на яку відповідно до п.26¹ підрозділу 2 розділу XX Податкового кодексу України ПДВ не нараховується»
